[Solved] What do we need?

My son is going to court in 2 weeks time to try and get access to his child. He hasn't seen her since September last year. When he did visit, the mother used to put the child on the floor and then barricade the area so that my son could not get in to play with her. Once she started moving around, she used to take her upstairs for the whole of his visit. He took photographs of her barricade on his mobile phone which he is going to print them off to show the court as she has told her solicitor that my son is not interested in interacting with the child at all but that is not the case. He has also written a diary of events - when he got to hold and play with her (most times she would not allow him to have physical contact) etc.

How many copies do you think we need to get? He has got a solicitor but he is just about as useful as a chocolate tea pot. He had a solicitor who seemed really nice and who knew her stuff but once she took on the case, it was passed on to the junior. So now the junior is up against the mothers solicitor who is a partner. Don't really stand a chance. 🙁

Try to be positive, your solicitor as a junior will be talking to the senior solicitors about your case I'm sure. As far as copies are concerned I would think you need a copy for the judge, one for the mothers solicitor and possibly one for CAFCASS as well as one for yourselves. Your solicitor will know for sure.

For those of you who have been to court for contact. How long did you have to wait for your telephone interview with CAFCASS? Son received letter from them in January and they said they would contact him shortly. He has now got just short of 2 weeks before going to court and still haven't heard from them.

What sort of things do they ask?

I have had a report wrote by Cafcass and I am concerned at how it lacks factual evidence and was completed within two weeks before the court date. Cafcass. The officer contacted the school via telephoned and didn’t want any school report regarding attendance, behaviour or lateness. And wrote a sweeping statement “no issues at school”. The Cafcass report also failed to conduct police or social services checks on my new wife’s partner who is stated as having caring responsibilities. . Surely his is not an section 7 report ?? any guidance on how a section 7 should be wrote.

Hi Bill

I remembered your post about a disputed CAFCASS report a couple of weeks ago, did you make contact with Brian Hitchcock?

If there are issues at school that havent been covered theres nothing to stop you approaching the school to get a written report of the issues that you feel the CAFCASS officer ignored.

I seem to remember in my sons case that the police and Social Services submitted their own reports to the courts alongside the CAFCASS report. These were ordered by the judge.

Why dont you telephone Social Services and ask them about the Section 7 and what it should include....they may clarify for you.
