Hi, I would like to know what rights I have as a father in going for custody of my 12 year old daughter. The problem is I live in Tenerife and she lives in the UK. I just dont know what rights I have, could someone help me please!!

Hi Nathan

Can you give any information as to why you want to go for custody? To be honest though, in my opinion, you are facing an uphill struggle as the court would have to agree to your daughter living in Tenerife which would cut off your ex's contact pretty effectively.

Hi, well the mum isn't taking care of her at all. My parents are in the UK and have my daughter every other weekend and have done since she was born. They are so concerned. The social services have been involved a number of times. She gets picked on by her brother who a couple of months ago held her up by the throat with a knife, and he is only 14!!! her mum and her mums boyfriend. We are just looking at ways of how to go about this all.

My daughter has asked if we could leave it untill she goes back to school, as she is going into senior school after summer holidays. She has said lets see what happens after a few weeks and possibly put wheels in motion after new year. And does anyone know at what age a child can leave home of their own choice? I know the law on schooling as I think is that they now have to stay on until they are 18?, but can they leave before hand if they have a full time job and somewhere to live? has that law even come into force yet about the age they have to stay at school?

My daughter is 14 & going into yr 11 at school. She is the 1st year who are going to need to stay in full-time education until they are 18 yrs old. Does your daughter want to live with you? If she does, this will go in your favour. However, the fact that she would only have limited access to her Mum would, I expect go against you. Have you spoken to a solicitor about seeking custody & how you stand being in Tenerife?
