Hi,

In short, i'm having to resort to taking my ex to court over contact with my now 2 year old son, in a nutshell I left her in may 2011 and because I wont get back with her she became bitter and wants to get me back, unbelievable I know.
I would like every other weekend and one night in between, but because she stopped access for the past 9 months he won't recognise me now, so I might not get that right away, i'm wondering if they'll suggest weekly supervised contact at a centre to begin with then work up to that? I'm quite certain my ex will dig her heels in through the court process to further get back at me and not cooperate with me by making up ridiculous accusations about me being violent and aggressive towards her, which is totally made up, surly they wont believe her as nothing has ever happened and cant be proved, also what penalties are in place so if she did break the contact order by not letting me have him she would be accountable and face penalties?

I know I may have scribbled this out fast , apologies in advance if id doesn't make much sense or seems scattered.
Any opinions, advice appreciated

Hi you pretty much have it summed up what she will try. Have you started court action yet ? and have you a solicitor?

I have contacted a solicitor and she says eligible for public funding towards the costs, no idea how much ill have to contribute each month could be £150 maybe don't no, they've just sent the case off to the decision makers to see whether ill get financial help

Don't get mistaken for what you are getting from the solicitors. My son thought he was getting legal aid and it turns out that it was just legal help. This entitles the solicitors to write letters, emails and make phone calls - that is all. He wasted a good 9 months with this. When he asked to go to court, they then told my son that he would have to apply for legal aid which took a good few months to get sorted out.

Hi,

I qualified for legal aid which as the below poster correctly stated only covers letters/calls ect, im told to take court action i have to apply for public funding, a cirtificate to cover some but not all other costs, they have sent the application off and depending on income / expenditure and what evers left they decide how much i have to contribute, i was told that it could be £150 looking at my earnings. I am employed.
