Hi, As you know im going for a fact finding hearing soon.
My ex is trying to us a witness statement against me for this, however her witness is her aunt.
Should this be admissable in Court? I don't think it should be as they are not independant.
How can I get this revoked as being admissable

Thanks

I don't think it's inadmissable - the statement is to a court and lying is perjury so a court would expect the same standards to apply whether it's a relative or not, though a court would be aware that there is more tendency to back your own family, and if that's the only evidence, then it's a bit weak.

I'd have a word with the CCLC on this if you don't have a solicitor.

if its community legal advice, they are no good as I can techinically afforda solicitor but I chose to self represent.
I have asked the judge disregard it due to the fact the wtiness is bias to the respondent, but wondered if there was a law on this that I could use if the judge refuses

They are free legal advice - the only condition is that you don't currently have legal representation, but there's no test on whether you can aafford legal advice.
