Hi all

I have a 3 year old son with my ex, we have been seperated for the past 18 months, for this time she has been recieving payments from me calculated by the CSA, just to make sure that Im not overpaying and also that she is getting what she is entitled too.

Anyway my question is, I currently give her 15% of my income after tax. I live in the uk but Im thinking about starting a business in Spain and getting my dad to run it. Will my ex be entitled to any money that I make from the business or just the money I make in the Uk??

Thank you

Matt

Id also like to add that I will always work in the Uk and provide for my son, I just feel that what I currently give her is more than enough.

Thanks again

Matt 🙂

Hi
Check out the CSA website if you already haven't. I am pretty sure you would have to give full disclosure of your income and if you go to court they will ask for a full disclosure if your ex knows about your thing in Spain. My cousin started a rental car business in crete and had his mate run it. My cousin stayed and worked in the UK. His ex easily found out about this and informed the csa . To say the [censored] hit the fan is an understatement he was hit with a bill (if you want to call it that) back dated to when he started his business in Crete. Each case is individual but i thought i would just share that one with you.

Yep, k@rtis has it right. I believe it is an offence not to disclose full facts to the CSA when they ask so you could end up in trouble. You have to be careful of anything you may do legally to reduce your income from the business also as that may be a diversion of income which is one reason she could apply for a variation. If you are paying her the full rate out of your income here, you might (and there's no guarantee) be able to put a substantial amount of that income into a pension, which could mature when your child hits 18, but it is a risky strategy.
