Hiya,

been busy with kids & work lately so haven't been on here much.

my kids are 7, 6 + 2. they mean everything to me and have kept me going over the last few months.

i see them very regularly, even more than their mum does. i have them on average 4 nights out of 3 every week and every other weekend. we are amicable where the kids are concerned, but my ex and I hardly talk.

she wants a divorce, and has done since the first week she moved out. she was cheating on me with someone she works with and he now lives with her. (he is also married with 3 kids) a very horrible situation 🙁

but, onwards and upwards! can't keep me down!! 😉

Hi Rob

I would suggest that while things are amicable, you try to get residence and contact sorted out as soon as possible - if you can't agree on the arrangements, then get it to mediation. The reason I am suggesting this is that as arrangements stand at the moment, child maintenance could be paid to you rather than your ex, plus you have a good case to go for residence - this would mean that your ex (assuming she's working) could end up paying you maintenance. Once your ex realises this, she may consider cutting down your contact to keep the child benefit and get maintenance from you. I'm not sure whether you would be able to go for shared residence and then come to an arrangement that neither of you pays maintenance and that child benefit pays for schools uniforms etc - such an arrangement certainly seems to be suitable in your case.

If you wish, I could ask Child Maintenance Options to pop on and comment - let us know what sort of arrangement you are considering.
