my ex is demanding i give her 250 pound a month even tho they have everything they need at my house , according to the csa i should be giving her 12 pound per child per week.............

i really don't know what my legal rights are or where i stand at all

Hi Rik and welcome to the forum

I've moved your post into a separate thread as I think it was going to be lost amongst all of the other posts.

Can you give us some more information - number and ages of children, any contact orders etc and we can work from there.

OK, I think we can assume there is no contact order - if there was one, you'd have been to court to get it and you'd know what it was, believe me.

Are you named on the birth certificates, if so, you have parental responsibility, which gives you certain rights - though not contact.

Can you explain where you get your child maintenance calculation from - according to what you have said, you should be paying £24 per week, but for 2 children, the CSA calculation says 20% of your takehome pay unless you are receiving less than £100 per week, in which case it's a flat £5 per week. It's certainly not £250 per month, so your ex can't demand this. There is also a deduction (though not if you are paying £5 per week) if your children stay more than 52 nights per year - and it sounds like yours are staying 78 nights.

Is your ex making contact difficult at all?

sorry for the delayed reply i have been really bust at work the l;ast few weeks ,

the ammount is what she told me the csa have said i should pay her and to m,ake things even better she has asked me for more money as the money i give her isn't enough !!! but this co-insides with her being pregnant may i add .

i think i should contact the csa myself and what is this about a reduction with them staying with me more then 52 nights ??

I would speak to the csa yourself, they should be able to give you an idea of what your payments should be. The 52 days is the point at which the payment you make starts to be reduced. Anything you pay over the csa calculated amount is entirely up to you - there is nothing your ex can do to enforce it.

I would point out that the csa hace new rules from the start of this month, so definitely worth confirming what I have said with them.
