[Solved] Mother taking child to live abroad

Hi,

I'm new to the site and had a question that i was hoping someone could answer.

My daughter is 7 years old and since she was born me and her mother agreed joint custody, she is now telling me that she is applying for a visa and will be moving to Australia next year.

obvioulsy i dont want this but she is telling me i have no rights over the fact because she was born in 2004?

is there anything i can do?

I am not an expert but I would put the claim through the court. If she will take the child overseas and you are paying the child maintenance - I don't see reason why she wouldn't have to pay for your kids flight ticket once a year for i.e. full holiday period (as the child maintenance is for the child not the carer). This should allow you to have your child for 2-3 moths during the year as one-off rather than occasional days.

I understand that she has right to take the child overseas with your permission and if she can't get one - it will have to be done via court case. I read that the parent can only take the child for holiday period up to a month without written permission.

Hi RAE

do you appear on the birth certificate? If so, you have parental responsibility and she is not able to take your child abroad without your permission - she would have to apply to the court if you refused to give permission.
