Hi,
Just joined and hoping to get some advice as to how maintenance is worked out by the CSA and in particular how they stand in contacting employers to get information about pay

Hi

Currently, the calculation is based on takehome pay - 15% for one child, 20% for two and 25% for three or more. There may be deductions in certain instances, and I think generally, they will ask for a couple of payslips, and they have the authority to get information from the Inland Revenue. Is there any specific issue you need information on?

Thanks for your reply to my question, but to be more specific can they just phone up an employer and ask for information.
My payslips showed me doing overtime, but the amount was a one off. They have taken this amount to be a regular overtime amount, which it isn't. It would appear that they spoke to my pay department who gave the impression I did this amount all the time.
So I have had to ask for the CSA tp look at it again, which is a total pain.
I was under the impression that they could only speak to your employer if you were in default ?
But unsure if this is true, so am looking for more advice.
The CSA are totally unhelpful and I can understand why so many people get annoyed with them.

Ah, I'm not 100% sure of this, I think they can speak to them if they think they aren't getting accurate information - I would certainly speak to them again and offer to provide payslips going back over 6 months or more.

One alternative if you are prepared for a battle over it, is to calculate what you think you should be paying and pay this amount only, and write to the CSA to explain exactly what you are paying and how you have calculated this. In theory, you will go into arrears, but to recoup those arrears, there are procedures that they have to go through, which, as far as I recall, involves going to court to prove the arrears. At this point you can go along an provide figures to show that their calculations are based on incorrect figures. However, it's quite possible that they won't go this far, as they'd look pretty stupid going to court to prove something which is plainly incorrect.

It's certainly worth researching what actions the CSA can take in the event of any arrears - I think the CSA should have a booklet which explains some of this, but it will also probably be on their website.

Hi,
Thanks for the reply its pretty much as I thought. I am giving them more payslips and hope they see the error of their way. I'm more concerned with the way my employers tell them without mentioning it to me.
But as I give more than they're asking for I'm covered, just don't like them being able to do want they want.
