Afternoon all just update received my non molestation order around 11am served to me...remote court hearing is on 8th March..just looking for any last advice and help it getting things organised many thanks
Sorry to hear that. There are some good advice guides for representing yourself in court at www.advicenow.org Write some notes about what you want to say and keep calm. Even if an order is made it does not mean that you are unable to see the children. The order can be worded that there is no contact except for the purpose of making arrangements for child contact. You might ask for this. You might also suggest undertakings if it looks like not going your way. That means that if you do breach the order - or she claims you have, you won't be arrested.
I was thinking that if you get an order that says you mustn't contact her then its not going to be possible to arrange child contact. If she's stopping you seeing the children then when your C100 hearing happens and hopefully you are allowed to see the children, the non mol will need amending. The usual phrase is no contact, direct or indirect save for the purpose of arranging child contact. It may be that you have to arrange contact through another family member. Its a point to bear in mind when the order is drafted.
There is a good explanation of a non mol hearing at Direct2barrister.co.uk
Hope it goes well
