[Solved] Occupation order

Hi me again with my problem n still don't know what exactly I should be doing.

Went to mediation this morning same old rubbish took details and book another appointment. Nothing been discussed just the mediator told me to move out of the house to then thing will be different. As I said earlier in my mail that my ex she left the marital house and leaving with her parent and it has been 10 weeks since I saw my kids.

Today before the mediation was about to finish the mediator gave an envelop and said it is from my wife. Guess what? She made an application for occupation order and I need to be in court for 28/06/12 at 11:00 hours this Thursday. I don't know what to do am so stress tried to contact my solicitor she is off and went to CAB they can't help, where do I go.

I have gone through the application and it look like she wants me out of the house and she has come with lots of excuses saying that my girls and her health are affected because of me. She sleeping on the floor at her mum place, the kids get disturb, my daughter routine is affected and her breathing is getting worst (asthma) and my other daughter eczema is getting bad and so on. She also added a report form the doctor and even the school wrote a letter for her to support her on that. You all these look like it is not going my way and she is winning all the time preventing me to see my kids, getting me out of the house, and taking all my money,

Please tell me what can i do in this situation. It is getting bitter everyday and am looking contact with my kids.

What suggestion can you give when for Thursday when I will go to court. How can I prepare myself to stop that occupation order. It will be of great help if you could help me.

Hi,

It doesn't sound like you've been given much notice to get ready for this, however if you were hoping to have a solicitor represent you, you could ask the practise if they have anyone else there who could represent you. If not, do you know what outcome you are hoping for e.g. if you both own the house are you wishing to sell it? Or keep it?
