Hello I am new to the forum and so am posting in this Welcome to the Forum section although should it be in the Money section ?
I have a son lives with his mother and her husband. He turned 19 on Dec 29th 2012 and is currently studying his 3rd year of A levels after retaking his first year. I am paying a monthly maintenance amount via the CSA. I have been told by the CSA a couple of times over the last couple of months when I enquired that I just need to call on or just after his birthday and the case will be closed.
However when I called yesterday I was told that the rules have just been changed on Dec 10th and that I have to keep paying until he is 20 !
Does anyone know if this is correct ? as I can't find any info on the web anywhere and also the HMRC website clearly states 19.
If this is correct - do I have any recourse as CSA staff I have spoken to a couple of times recently have not mentioned this change and have stated that it ends when he is 19.

Its now gone to 20 on the 10th of December 2012 I found this for another Dad whos son turned 19 on the 10th and he got told he had to pay for another 12 months , you could write and complain but to be honest you wont get any where with them there a law unto themselfs. Its being scrapped in 2014 and I think there trying to get every penny they can

The definition of child applies to all children in the scheme: a qualifying child, a relevant other child, a child supported under a family-based arrangement and a non-resident parent who is a child.

The definition of child should be the same as used by Child Benefit for those aged up to their 20th birthday. The 2008 Act provided an increase in the age limit of a child from 19 to 20, mirroring a Child Benefit change made in 2006.

The Regulations provide a definition of child which cross-refers to that used by HMRC in Child Benefit legislation. This covers situations where a child aged 16-19 in specified circumstances, for example, undertaking full-time non-advanced education, continues to be eligible for Child Benefit.

Thanks for the info.
It just seems so unjust that I had no forewarning from the CSA and was in fact recently told the exact opposite by them that it ends at 19. I have been struggling to pay my mortgage and so had arranged for it to be restarted this year and so don’t understand why I could not have been forewarned.
I have one question when you said ‘and I think there trying to get every penny they can’ I understood that the money I paid went straight to my son’s family - is this in fact not the case and instead the CSA keep some or all of it ?

You are correct that everything you pay goes to the family - I think AK just meant that the CSA are trying to get everything they can out of the non-resident parent before the rules change.
yes thats what I meant, thanks actd. It does seem to be more and more Dads coming on saying they have been hit with massive bills from the csa
