Hi,

I need some advice about if possible. My ex wife who is currently under social services investigation for alledged abuse to my son has contacted the CSA because she believes I have made the complaint.

I already pay her a set amount every month but she is demanding more. The original divorce paperwork states that maintenance is voluntary (think I spelt that right!), does this now mean that the CSA can over rule that court order?

I am going to court on the 19th October for a residency order but in the mean time I could do with knowing what to do about this new aggrevaition!

Many thanks,

It sounds like she is lashing out because she believes you to have made the complaint - when you made the agreement with her did you involve solicitors?

Not sure if the CSA will do anything but it may be worth checking with the CSA guide that is available

Hi

If the maintenance was written into the divorce agreement, then it holds for a year, after which your ex can use the CSA which would then override the court order. Have you checked the CSA calculator to see how much you would pay?
