Hi- My wife went on holiday to visit her parents in Israel with my son 10 months old( 2 weeks) ago and decided not to come back, she says she hates the country.

I would like to hear from other father who live in different countrys from there children and find out how they cope and how there relationship if with the baby/young children.

I know all about the hauge and my rights to get them back but i also know that she will apply to go back to Israel and probally win in the end.

I look forward to hearing from anyone in my position.

Was your wife born in Israel, and also your son? If not, I don't know what their rules are for living there permanently, but I would say that this is child abduction - it could be worth having a word with the Israeli consulate to see what advice they can give, if any.

I'll ask the CCLC to pop on and give any advice they can on what your options are, legally speaking.

As your wife has only been away for a couple of weeks and you agreed to her leaving?? then it may be hard to prove abduction.

I would suggest you speak to your wife to try to resolve this before the situation is unresolvable

Actd asks if your wife is from Israel? Is she?

Hi rcel79,

thank you for your query.

Not much information is provided in your question, however, in general terms we can tell you that if a parent removes their child from the Uk without appropriate consent they are committing a criminal offence under the Child Abduction Act 1984. Your initial consent to the holiday will not change this.

If a child has been abducted from the UK, there are two international Conventions that may assist a parent in tracing and returning their child. The Conventions are known as The Hague Convention and the European Convention.

These are complicated matters, however, and you may consider contacting a solicitor specilaised in International abduction and Hague convention cases. We would also direct you to an organisation called REUNITE (www.reunite.org), advice line +44 (0) 116 2556 234.

Should you require any further assistance, feel free to contact us at 0808 802 0008. You may also consider contacting us via webchat, which can be accessed on our website www.childrenslegalcentre.com between 9am and 6pm.

Kind Regards
