CMS...like talking to a brick wall!!

I have been paying CM for my children with my ex-partner for a few tears now. For the past 15 months I have been fighting to get a variation added to the case to allow for travel expenses, as their mother won't ever meet at a half way point. During this time a court order was granted in favour of myself after their mother stopped contact for 14 months due to not knowing my new address (even though the kids were never brought to the house). I was awarded a minimum of 1 day a week contact due to the variation of what shifts I work, a set day couldn't be set.

On contact days, I would be doing 100 miles round trip which varies from 1 day a week to 2days a week. Given the cost of fuel, these trips are costing close to £20 each time. After having a number of applications denied due to lack of information and the RP stating that contact never takes place twice a week, CMS have taken her word as gospel truth and that I have made up lies! I have since noted down all dates of contact for the previous 14 months, showing that contact was taking place twice a week during a number of months. CMS have just informed me that due to the contact of twice a week not taking place on a regular basis (ie..happening every week) they rejected the variation application.

Due to my work role, there are weeks I can't do twice a week. Also, has anyone else seen their payments increased even though their pay hasn't gone over the 25% threshold?

 

Any advice on how best to deal with them will be much appreciated as I am pulling my hair out with their inconsistency.

hi,

with travel for contact, cost should be minimum of £10 a week. if they are not listening to you, I suggest you go down complaint route. E-mail complaint to arlene.sugden@dwp.gov.uk and copy in your local MP.

That's great thank you, I'll see what the response will be. The cost of the journeys is hitting £20 each trip so definitely meeting the threshold.
