Part payment in full and final settlement

Has anyone had any experience with a part payment in full and final settlement? My daughter is now an adult and to really try and cut the story down I am in arrears if around 8k the reason for it was my child wasn’t in full time education and I didn’t realise the case was still open so didn’t have any reason to notify them. By the time they notified me I sent over 19 documents with my child’s help proving she didn’t stay in education. This fell on deaf ears, I tried to appeal but because I didn’t inform them if the change (she lived with her mum at the time) I was out of their time restrictions to notify a change and it was upheld! I actually owe 2k when I worked it all out.

I just want this out of my life, I am suffering badly with mental health and am signed on, I am expecting some money through inheritance and because my case is arrears only no active case I was thinking of offering 2k lump sum to clear them. Has anyone done this before? And how was the process and outcome? I am honestly so stressed and drained from the whole thing

Hi,

So CMS saying you owe 8k? If you believe that is wrong, you should ask them to send a full breakdown of these arrears. You can ask your MP to intervene and contact CMS. Also, would your ex be agreeable to cancelling out these arrears?

@bill337 I have and they have. The issue is I have sent documentation to prove my child wasn’t in education at the time but because it wasn’t done within their timescales they dismissed it. I then went to the tribunal and submitted documentation and again it was dismissed because of timescales. I didn’t inform them because I didn’t know and my daughter was luck no with her mother.

I believe that the CMS generally don't backdate, on the basis that there's a duty to update them with any changes. I don't hold out a lot of hope, unfortunately, but I agree with Bill that you should involve your MP - if you have proof that she wasn't in full time education, then the mother also has that duty to inform them. It might be worth seeking legal advice (Citizens advice bureau could be a place to start), again, this is a long shot, but you could consider a claim in small claims court against the mother for the exact amount that CMS are claiming off you, so if you have to pay her, she would have to pay you straight back.
