Hi
Is anybody else out there not being able to see there children even though it's set out in government guidelines??

yes i am in same boat. nothing much i can do about it. just hope schools don't stay closed till september. 🙁

Yes me too. Despite the government and CAFCASS guidelines i'm being stopped from picking up my daughter. No one in either household is classed as 'high risk' or have underlying conditions but the order in place has been breached. We were supposed to have our final hearing last week but this was adjourned for 3 months because of the virus.

I am also in this boat however my ex is on immunosuppressants so I have some sympathy for her situation.

My hope is that it can be written into the court order that my daughter stays with the healthier parent during times of pandemic or similar situations as it doesn't make much sense for a child to be with the physically compromised parent. Well in my situation at least!

the head of family court made it easier for some parents to block access:

Government guidance issued alongside the Stay at Home Rules on 23rd March deals specifically with child contact arrangements. It says:

“Where parents do not live in the same household, children under 18 can be moved between their parents’ homes.”

This establishes an exception to the mandatory ‘stay at home’ requirement; it does not, however, mean that children must be moved between homes. The decision whether a child is to move between parental homes is for the child’s parents to make after a sensible assessment of the circumstances, including the child’s present health, the risk of infection and the presence of any recognised vulnerable individuals in one household or the other.

Where parents do not agree to vary the arrangements set out in a CAO, but one parent is sufficiently concerned that complying with the CAO arrangements would be against current PHE/PHW advice, then that parent may exercise their parental responsibility and vary the arrangement to one that they consider to be safe. If, after the event, the actions of a parent acting on their own in this way are questioned by the other parent in the Family Court, the court is likely to look to see whether each parent acted reasonably and sensibly in the light of the official advice and the Stay at Home Rules in place at that time, together with any specific evidence relating to the child or family.

so ex posted that link to me and told me that moving kids would be unreasonable and irresponsible. lol

Hello All

This must be so difficult for you all, not being able to have that direct contact with your children - I know it's not the same but are you able to arrange FaceTime/WhatsApp video calls so you have an opportunity to see your children and spend some time with them. Depends what technology you have available to you!
It's really important that your children retain contact with you and know that you are there.
Extended phone contact could also be a possibility so that your children have an opportunity to chat with you - read them a bedtime story before they go to sleep.

Hopefully partners are supportive of some form of contact going ahead and between you, you can be creative around contact and how this is done.

my 2nd hearing is end of april. hope it goes ahead as planned. only glimmer of hope i have is that cafcass woman doing section 7 report. will call me next week. ex is being a pain even with video phone/video contact.

But that is what the government suggest only if either household have underlined issues....which neither of us has......this will be the 5th court order she has broken....so I know the real reasons.

yes, court/cafcass and all the normal people expect parents to act reasonably in this time and in the childs best interests. sadly some of us dads are having to deal with 2 dangerous viruses.

Government have brought this guideline in...so it would be nice if they acted on it for those who aren't able to see there children.

Unfortunately everything the authorities do is geared towards the mother....it's very very frustrating......my ex has broke upto now 5 orders.

Does there not come a point when you can say she is unfit as she keeps breaking orders and you do not want your child growing up with a parent with such scant disregard for the law? There must be something you can do.
