[Solved] Overnight Access

How likely am I to be granted overnight access if I do not have a place of my own and my son dorsnt/won't have his own room? I.E living me shared housing, friends/family. Can I be denied overnight access if I dont have my own permanent home?

to be honest, yes you're likely to be denied - as this is about the boy, not you.

You can sometimes share a room temporarily if its a transitional thing and the child is young and mother willing. permanent home isnt really the issues.

A friend of mine went to court for CAO for his 5 year old daughter as the mum was hostile to contact.

He ended up with every other weekend 3 nights at the house he shared with his mate (they are both male in their mid 20's). She had her own bed in his room.

The mum wasn't happy and said that the girl would be sexually abused as there were only males in the house and that the house was unsuitable. Social services went to the house and made sure it was safe for a child and reported that there were no issues and as the girl had her own bed in the same room it was fine.

And recently social services have confirmed to us that there are children who stay with their dads in the same bed due to limited living arrangements and for a toddler this is acceptable.

My lad is 4 and starts school in September. I stay between brothers and my parents and house shares with no room to exclusively offer my son. Sometimes even girlfriends and hotels. Given my far from ideal circumstances is it worth my while taking the mother to court for overnight stays?

That sounds a bit unstable for overnight contact. Is there no way you can rent a room somewhere and provide a bit of routine for when your son stays?

I think the court would want you to have somewhere a bit more permanent

I have to agree with spottedtree Nish, permanent doesnt have to be mortgaged etc but my son knows my place now and where stuff is etc, its more about that, children arent nomadic

A judge may well consider if you live in a shared property but I think you could have difficulty convincing them to listen if you're between locations.
