[Solved] Cant Afford The Full Child Support Amount

Hi all,

I have what currently seems to be an unsolvable issue, at this stage, which requires information from anybody who has experienced similar.

Up until 3 years ago I had worked offshore in the oil industry for 18 years, earning very good money. However, the work dried up due to the price of oil and I became unemployed along with 170,000 others in Aberdeen alone.
Therefore, I had to retrain and have now secured a reasonably paid job, which allows me to send money to my son every month.

The problem is, my divorce has now been settled, demanding £1000/month, based on my previous earnings and with my current financial stays, I simply can not afford to half of the required sum. (previously wanted £2000/month)
My retired parents are paying half of the child support so that I don't lose my home, however, their finances will soon run out.

My ex wife and son live in Poland and this is a decision made by what seems to be a corrupt legal system where the judge has based the decision on emotions as apposed to the facts presented to her.

This outcome has caused many a family problem and I am constantly looking over my shoulder, not knowing when I will no longer be able to afford to work.

Does anybody have any words of advice?

Hello Lee003,

I am sure one of the moderators on here will be able to offer you advice. I personally am not sufficiently knowledgeable to do so.

I'm a little confused and would like you to clarify, is the £1,000 per month part of the divorce settlement paid to your wife for her benefit or is it solely for child maintenance?

If this decision was made by a polish court, then you'd need to seek sppecific advice from someone who knows the polish law, as the British courts won't generally override decisions made in annother country.

Hey MOAF,

The £1000/month is purely child support.

I just fail to understand how the Polish court can order that amount based on my earnings 3 years ago.

After all, circumstances can change and the fact that there is no work available offshore could ultimately leave me on the streets, once my assets are drained by my greedy ex.

ACTD,

The court process has been handled by my lawyer in Poland, and she cant understand how the judge came to this figure considering my earnings.

All I want is to provide my little boy with a sufficient amount each month and to get on with my life.
