[Solved] Application for access & CRB

Hello all!

Mine and my partners relationship recently broke down and we have a young baby. She has filed a non-molestation order against me based on domestic voilence. The evidence she has given is just a very bad relationship twisted in her favour, I went today to present my evidence but I am worried as her solicitor has said she is seeking evidence from the police & doctors??

Now she has threatened me that she will ring the police during an argument but I have never known her too! My worry is if she has then I will look extremely guilty!

I have 2 questions...

If I leave this injunction in place then will it come up on an enhanced CRB?

and

If I want access to see my son how will it be effected by this injunction?

I am willing to take supervised visits etc...

Any info will be greatly thanks!

Heya, sorry to hear the recurrent unfortunate situation which many of us have experienced.

Lots of this will depend on police reports / evidence from the doctors....allegations post separation usually whiff of being retrospective.

1) Depends on whether you accept her allegations. If you do this may be used in future hearings about the kids as she may wish to use this as a case that you may be dangerous to the children.

The injunction should not appear on your enhanced CRB as this is private law. If you deny the allegations but perhaps offer to give an undertaking the nonmol order maybe revoked.

2) Keep writing to her solicitor and explain that her allegations of DV are against her and not the child. Therefore it is important to facilitate contact with the child as it important that they do not disrupt the bonding between father and child.

Were you at court? Or was this via solicitor?

If solicitor keep contacting to get in touch with your child......
