[Solved] Clarification of the FM1 form

Hi

Heres a quick question relating to FM1 forms as well.

From what I have read to make a court application then a court required an FM1 form showing that mediation has broken down. I understand this part.

Looking at the FM1 form though there is a part 1 which implies that one can apply to court - without attending MIAM providing the criteria listed is provided.

So for example if a partner is claiming DV - in theory they could apply to the court, negating mediation (MIAMS) providing there is supporting evidence to do so.

Is my understanding of this correct?

In theory yes- but judges may order attending mediation. It is better to have demonstrated resonable behaviour and offered it and she doesnt turn up and if she does get it signed anyway.
