Hi guys
Well it's only been a week and she's breached the order twice. She is meant to present all children for Skype and telephone calls and that's not happening. He's asked why his eldest isn't present and gets no response. This doesn't bode well for the contact centre and he's got to pay for that whether she turns up or not. Sorry for more questions but can anyone tell me what happens if he has to go back to court to enforce the order, will it cost more money? There is a review after 6 months but it can't wait that long. I really wish his case had got to final hearing, there is no way this woman will work with a consent order, it's just wasting more time and causing him more heartache, this evil woman is the one guilty of emotional abuse yet no one cares.

I would advise that he writes a letter to the judge that made the order in person, outlining the breaches and requesting a return to court for urgent new directions. The judge has the power to bring it back to court and as there is a review hearing in six months, that would indicate that the case is still open.
If this doesn't work he can apply for new directions to the existing proceedings, that is done with form C2 and I think the cost would be £90, although not 100% sure on that.
Alternatively he could write to the mother (or her solicitor) and remind her she is in breach of the order and that if this continues he will have no hesitation but to return it to court for urgent new directions/enforcement.
