[Solved] Court order

A few years ago I had to go through family court to see my daughter and have access to her. Eventually I won after jumping through every hoop that was put in front of me for three years. But I did as was asked of me. And got on with it. A court order was written up and I would have my daughter every few weeks. Overnight etc. This all went very well. . . Now in January this year I was sentenced to 6 months imprisonment for a domestic with my new partner. Now my ex missus is saying I can’t see my daughter and I have to contact social services. Social services have told me they can’t deal with it as there’s a family court order in place. And that I have to go back to court to resolve this issue. Can someone help me or give me some kind of advice on this matter please. And what to do. Thanks. Can anyone also tell me if she is in contempt of court and breaching the order by not allowing me access to my daughter. When there is an order written up. Thanks.

hi,

in this situation you should apply to court to enforce your order. sounds like it will be long-winded. as courts social workers cafcass will likely do a safeguarding report in light of your conviction/imprisonment.

Hi JN

Did you serve time or was your sentence suspended? Did you have any rehabilitation activity to complete such as BBR? Did you get an extended licence or just 6 months?

Whilst your ex will be in breach of order, the reason provided will probably be allowed by a judge (safeguarding).

Depending on what happened and the sentencing will determine your next steps in relation to your kids..
