[Solved] Thrown backwards from High Court.

I have a case, that was resolved in the high court after a false allegation in June 2017. Then in May 2019 another false allegation was made, and it was brought back before the High Court. In total my children have been out of my life for the best part of 4 years. The new head of the family division of the high court now says she is minded to send the case to the family care centre, as she feels it’s not complex enough for the high court.

This comes as a surprise as an appeal is guaranteed within the high court, and as I had just the day before informed my solicitor that if a change of residency was not made, I wanted to go straight to appeal.

Is the judge trying to remove my right to appeal by throwing it back ?

Why would she do this when it’s been before the high court on numerous occasions ?

hi,

i think they just want to stop repeat court hearings that clog the system. or maybe they realised that the allegations are bull so they not taking it seriously. at my last hearing they told both of us they don't want to see us in court again lol. 2 c100 applications made within a year.

What I cannot understand is that the allegations were so serious, I could have spent a lifetime in jail. I was arrested and thankfully cctv proved it lies. Then she stopped my daughters getting emotional support, and lied to the social worker, then she made more, really serious allegations. Each time one of my daughters was hospitalised. All of them were examined and interviewed, and they all went on the child protection register since living with her. Plus, she twice tried to get them out of the country. It’s been before every high court judge and the lord Chief Justice. How the [censored] does it not deserve to be resolved in the high court ? If it goes to a lower court it will be in court repeatedly for years. Even if it is resolved in the high court, there is no way it’s not going to appeal. I think the judge is passing the buck to avoid her case going to appeal ?
