Hi all

I've just been granted lives with (shared with mum) and have also just been informed I will recieve child benefit from 1 of the two children I have a CAOb with.  I'm in for 46:54% ratio schedule. 

What does this mean for child maintenance.

hi,

with child maintenance via CMS, there is no maintenance to pay if you have equal day to day care of children, does not necessarily have to be equal number of overnight shared care.

@dadmod2 thank you. I've been through reg 50 and lost at Tribunel as I marginally have less care apparently. She lied all the way through it. Though since then they've agreed I get child benefit for one of two children. I've also been to court in last week and got lives with both order. I've looked at the policies and regulations and it suggests I can item a case from CMS to her?

They've sent a letter saying they going to ask her if this is true (she will deny though I have lives with order) and if she is in receipt of Child Benefit which I've provided the hmrc letter....

Does this change anything?

hi, as you claim child benefit for 1 child, this possibly gives you option to open a CMS case against your ex. If she receives benefits then you will likely receive £7 a week.
