Notional Income & Evidence Child in Full-time Education

Good morning. Can anyone offer any advice?

I recently had a financial settlement with an ex-wife. The child is not from the ex ... he's from another partner.  Child is now 18 and mother has said child is in full-time education - CMS said they take the mothers word for it so I continue to pay CMS for a further 2 years until he's 20. Not a problem paying. Has anyone else had to ask for evidence child is in full-time education and if so how do you get it?

Also, received a letter relating to notional income from assets - I don't have any assets, however I do have a lump sum from a financial settlement. I work part time term time only so this is not regular income.  What/do I need to declare any assets??

Any advice, much appreciated.

Hi Biker2025,

Firstly, there is no evidence you can give the CMS regarding full-time education the CMS will accept, they exclusively take their lead from Child Benefit. In other words, the parent whose name Child Benefit is in needs to inform them the young adult is no longer eligible.

The Notional Asset claim is a touch complex, it applies to any asset which can be exchanged for cash worth over £31,250. If so, 8% of the total value is added to a PP's income and then added to the schedule.

The way to see a claim like this off is to split your lump sum into different asset types, each below the threshold such as an ISA, premium bonds, Bitcoin and so on. Write a letter in Word including all your details and the reference for the letter you received. State that you have no assets which meet the £31,250 notional income claim and none which are generating more than £2500 annually in interest. Save as a pdf and upload to the portal.

Unless your ex has proof you should be o.k, hope this helps.

Hi 

I had always paid Child maintenance (private agreement) and when my daughter turned 18 she  pulled out of college. I 
Then emailed college and got evidence from HR. Only because my sneaky ex partner tried putting in a 20 week extension on CB 

If you feel she’s fraudulent claiming you can also report that to CM / CB
