I have a court order which states I have 6 out of 14 nights.  So 60/40 plus half the holidays.

The cm calculator it seems doesn't take into consideration holidays. How do I work out what I should be paying? Do I have to open a case with cms?

hi,

CMS use shared care bands. so they would put you in a band depending on average number of overnights per week: 

  • 52 and 103 nights: child maintenance is reduced by 1/7th for each child
  • 104 and 155 nights: child maintenance is reduced by 2/7th for each child
  • 156 and 174 nights: child maintenance is reduced by 3/7th for each child
  • 175 nights or more nights: child maintenance is reduced by 50%, plus an extra £7 a week reduction for each child.

try to work out which band you fall under

But do these bands include the shared holidays?

am not sure. they way they worked out mine is checking court order, putting me in band B, 104-155. classed as 2 nights a week, with 4 extra nights. I don't have equal nights in half terms. have 1 week in xmas, easter. 2 weeks in summer.

As far as I am aware, it's a straight calculation of the number of nights with you, so if you can work that out and prove your calcuation, then that's your starting point.
