I need some guidance on this as i cannot see anything out there on CMS regulations.
My child turned 18 and went from College ie further education to University which is higher education.
The issue is they still took CMS payments despite her being up to 20 years of age.
I argued that she was in Higher Education and applied for a MR but it was declined.
ANy guidance on this - thanks

I have seen some letters that CMS send to some parents, that because child is aged 20, they no longer qualify for child maintenance and are taken off their system.
You must have a child maintenance arrangement if your child is under 16 (or under 20 if they are still in full-time education).

The CMS can only ask you to pay maintenance if all the following rules apply to you and your family:

you’re all ‘habitually resident’ in the UK

I would suggest you put in a complaint to their senior manager; Arlene.sugden@dwp.gov.uk and copy in your local MP to the email.
