CMS Court Tribunal - Help!

Good Afternoon All,

 

Any help and guidance on my situation would be appreciated,

My ex and I parted ways in early 2017 and she was granted custody, we have 2 daughters. In Aug 2018 my eldest daughter decided she wanted to live with Dad and go to School where I live (my ex and I live 30 miles / 1 hour apart) 

At the time we both informed the CMS of the change and all finances were adjusted and confirmed by the CMS as I was now the resident parent. My Daughter lived with me for over 2 years until Nov 2020 when she decided to move back in with Mom. Again my Ex and I informed CMS of the change.

Fast forward to July 2022 and out of the blue the CMS contacted me saying I owe Child support for my eldest daughter from late 2018. 

Despite my best efforts trying to explain my daughter lived with me Aug 2018 to Nov 2020 they have completely disregarded that fact. I feel like I'm banging my head on a brick wall. 

The CMS state I owe over £2500 in arrears and I have requested the breakdown of costs on 4 occasions since July of last year. As yet they have failed to supply this. 

It's now Jan 23 and I am now going through a court tribunal. In the meantime they have started to take money directly from my employer. I asked the CMS to suspend that action until after the tribunal but again I've been ignored.  

I have provided my letters from the CMS to the tribunal/courts at the point my daughter moved in with Dad acknowledging the change in primary carer and my award of child support from the non resident parent, this along with a letter from the school confirming my daughter was a pupil and I was registered as resident parent. 

I'm at a loss, the CMS are taking £1k straight from my salary at the moment and anything I say to them or sent through their website just gets ignored.

 

Any Help, tips or guidance would be great

Hi,

I suggest you get in touch with your MP and ask them to intervene.

I never thought about contacting my MP, 

How ill that work? Do they contact someone within the CMS on my behlaf?

@bill337 Great, I've dropped my MP a message. Hopefully he can intervene as the silence is deafening!
