Hi,

I am here to give an honest first hand opinion that is all and i hope i am trying to help. Admin will give a more structured answer.

If you dont have PR dont worry to much, the courts will grant that no problem.

If the CAFCASS letter "slags you badly" then first of all the mother somehow needs to prove these allegations are true in whatever she is slagging you off about. Courts very rarely stop fathers seeing their children just like very rarely punish mothers so its a double edged sword. I got torn limb from limb in my section 7 but i wasn't stopped from seeing my child i just had to jump through various hoops in order to regain contact through the courts, hoops at the time which were not possible for me to complete so im still stuck in this same rut. CAFCASS's reports do weigh heavy with court but i very much doubt a judge will stop you seeing your children. If this is your first court application then you stand a good chance of it being done in 3 hearings which is around 7/8 months duration. In my original answer yesterday, yes they do tear you apart, be ready for it, but its not all doom and gloom.

Best of Luck

Paul

Thanks I was thinking to write to the court about this concern as I brought it up with ex solicitor but nothing was written in the direction s .. not sure how to write to the court though express to my concerns . If one is on pip or was this I'm sure needs to be looked at in more urgently then my ex's alligations.. the alligations have changed that I drink 8 bottles of beer anight but never intoxicated . I shout at mom and hit walls .. and when I shout at mom my child runs to mom .. but at the time we was together my child was not walking and took her first steps two days before she left .. I have a criminal record last conviction 2003 and I attempted suicide back in 2002 and had deppession in 2007 that's all then I hurt my back and was off work with my daughter for a year..

Hi,

Thank you for sharing that information it gives an easier pic to read.

Past convictions are usually of no concern to the court, its usually depending on what you have done. When i made my first application back on feb 2014 i had a criminal history that reads like an argos Christmas receipt. I had spent time in jail for drug offences, i had driving offences and i also had assault and battery, there was nothing physical just threats but it is worded like that. CAFCASS bring your criminal history to court for the responded and the judge to look at. The court never paid any attention to any of my past convictions as they were only concerned about the now. If there is anything sexual or really violent then im sure there will be a different story. The depression thing may get looked at, depending on how severe it was and if you needed treatment

Hi I would love to start a thread how do we do this . I would love to go back to court and ask for more direct in as I feel it's all one sided .. before all this started my ex said to my solicitor agreed to every weekend 5 days later I had all these alligations.. arrangements to contact are very difficult and is going to take 4 weeks to arrange so I miss two contact s ..

It's quite simple to start your own topic.

1. Go to the top of the page, under the back to fitness advertisement, click on "Index"

2. Scroll down the list of sections on the index page, until you find the section you would like to post in and click on it.

3. At the top of the section you'll see three tabs in blue, click on the one that says "new topic". It will take you a page with boxes to fill in. First choose your subject/title and then type your message/post in the the box underneath. When you've finished click on the submit button and it will post to the forum. 🙂

I drink to many energy drinks as well and drink 8 beers anight but never intoxicated. Cafcas said supervised access each week judge said supported if ok as we are already doing that and know problems waiting for sec 7 , I have my own house that was the family home I work , but she shut my business down as she was on the lease , so I'm part time at the moment not sure what cafcas will use against me ,

Daveyfixit... I've started a new topic for you, it's called "Cafcass section 7 report, what next?" You'll find it in the legal eagle section. Hope that helps.

I had not contributed to this site for some time. I've returned to see the same issues arising over and over again.

To answer the original question: CAFCASS has a strong bias towards mothers. It is a pity, but that is what it is.

Good fortune to all those above with difficult issues.
