My 15 year old daughter came to live with me on 4th April and has chosen to stay. I have put in a main carer change with the CMS and started a claim for CB. The CMS have rejected the main carer change after investigating the change by calling my ex, who has claimed that the move to mine is not true.
How can I prove that my daughter now lives with me. Can my ex continue to lie to the CMS about this?
Financially I am struggling to afford to support my daughter and still continue to pay my ex CMS payments.
Any advice or experience of this is greatly appreciated.
It might be worth paying for a consulation with a solicitor on this one. One thing that occurs to me is whether your daughter could make a sworn affadafit, again there's a cost, but it's a legal document, it might be something that the benefits agency can use, but you'd need to get legal advice to check on this.

You could wait for Child benefit change to happen and let CMS know. Other option is applying to court for a residency order, to confirm that child lives with you. Then send order to CMS
