My wife sons father from previous relationship(were never married) wants to sign his parental rights over, myself and wife have been married to 4 years been together for six so i have raised him myself, he doesn't pay maintenance for him and never has, has decided after seven years of regular contact he doesn't want to see his son anymore for his own personal reasons we don't know why. Any ideas on how we go about doing this please? i have searched on internet but have had no luck on how to go about it. any advise greatly appreciated thanks.
I believe that unless he went to court to get Parental responsibility in the first place or he adopted the child, then he can't do it at all.
You could look at adopting the child yourself & I think in that case he signs to say he has no objection & you then adopt the child as your own & the the child is yours & not his, but someone with more experience on this may come along & give a more accurate answer.
I do believe though that there isn't a way he can just sign away PR. Sorry.

JAMES33 is exactly right and its as he says...If he had applied for and been granted PR in the past, or he had adopted the boy, then he could discharge the order. I would also point out that if the child was born before December 1st 2003 and they were never married he wont have PR anyway.
You do have the option to adopt, or if you want, to have PR. I'm in the same boat as JAMES33 and dont know a lot about the adoption process but it shouldn't be hard to find out. I would imagine the bio father would have to make an agreement, and this will most likely be in court.
Hi Im presuming the child is about 7 ? Is the Bio Father named on the birth certificate if so he has PR. You can apply for PR as well its straight forward to do that. If the father agrees you can adopt . I would want to know why after regular contact he is prepared to walk away and how will the child react to this and what about any extended family..
thanks yes the child is nearly 7, and his name is on the the birth certificate, he is married with two other children (one 6month younger)and i think he seems him as a burden, as does his wife as she has to look after him.theres far more to it but dont want to bore you all.
he is still seeing the rest of fathers family and father has fallen out with them aswell contact will still happen with his family regularly they have said they will support myself and wife whatever we do, and think i should adpot him as will be best for the child.
How do we go about starting the adoption process please and how would i go about getting PR for myself? thanks for your replies appreciate you taking to time to do so.
