Worried about losing contact in court when I want more

Hi Guys,
First post here! I’ve got a 2 year old son, I haven’t been with his mother (my ex wife) since he was 5 weeks old but have always have frequent contact. Currently this is every other weekend and every Tuesday overnight. 
There were accusations initially about me being an alcoholic. I did drink which was admitted to social services but I calmed it right down and my sons mother has been happy with this and allowed the contact I have after mediation nearly 2 years ago. 
She is now taking me to court for a CAO suggesting I am drinking again (which I’m not). I’ve always wanted 50/50 which is what I will ask for, but I am worried these unfounded accusations will stop contact all together or go backwards.

I live 5 minutes away from his mother and we both work full time, similar jobs and both flexible. 

What are the chances of getting 50/50 shared care at his age and with these accusations?

 

I can’t afford a lawyer so will be representing myself.

I would suggest going back to meditation again if you can, it's worked before so that's a good starting point. Has something happened there has set your ex wife on this course, such as a new relationship?

Hi,

If it does end up in court again and she mentions alcohol problem, then it's likely court would want you to take tests. Courts will consider many factors when making decisions.  I came across a dad recently who got 50/50 for his 3 year old child. It's  possible  but every case is different.

Drinking doesn’t make you ad bad parent as long as it doesn’t pose a risk of harm or neglect to your child. Furthermore you could even make undertakings to not drink on the days when your child is in your care.
