New CSA Case

Hi everyone. 

Just after a bit of advice if possible, recently had a new baby from a partner that i separated with prior to us finding out she was pregnant.

Long story short i've paid maintainence for the first few months but she has contacted the CSA regardless, they have took my last p60 income (during covid we've been given a lot of double time overtime sporadically & i took full advantage). 

Trouble is that this has been stopped as of August & wont be returning so will be on a basic wage, the CSA have calculated my income as £11k more per annum than what it is & will be going forward, would leave me with negative disposable income.

I have spoken to them about this & they can see my September payslip (which is the first one with zero overtime & therefore a basic wage) & they have still sent me a letter saying my income is the amount from my p60. It is within the 25% rule so i'm just a bit baffled that they have just ignored what i have told them. 

Has anyone been in a similar situation at all? not sure what to do, i cant afford the amounts they have quoted for any more than a couple of months tops.

If your income hasn't changed by more than 25%, then they won't change the amount you pay until the next annual review. Has your income dropped by less than 25%, and if so is it fairly close? If so, then you could increase your pension payments to take it to just over the 25%, in which case they will then review you payments earlier.

@actd yes i've about 35% decrease, i used to do a lot of overtime, my last 2 payslips show the reduction as well.

@happygolucky16 hi, I have heard that if the change in income is to last 12 weeks or more, then they take it into account, where income has dropped by 25% and more. You could try ring them again for explanation, or wait for a 3rd month payslip with evidence of the 25%+ drop in income and call them and send them evidence.

Hi

The CMS/DWP get a direct update from HMRC and need to see 2 payslips from which they work out the average salary and use that to calculate increase/decrease. The 2nd monthly payslip won't show until around week 10 and then it takes them a couple of weeks to recalculate the payments hence the 12 week timescale..

 

As your salary has decreased by 35% this should be straightforward although you will have to wait for the timescales..
