Turning 16

Hello, my child turned 16 in October 2020 and I'm still paying maintenance now.

My next annual review is coming up in the next few weeks.

Is this correct procedure? I thought the payments stopped when they turned 16?

I am not sure if they are going in to further education as all lines of communication have been cut.

I am just after some advice. Thank you.

Not sure, best ring them mate.

When I spoke them about it I'm way off the mark at the moment another 12 years. They told me if they go into full time education you have to pay until there not. (Up until they are 20)

But if they are earning money you don't have to pay, not sure if this correct because the problem with cms one person says one thing and then the other says something different.

I even asked them well what happens if the mother just says there in education will I receive proof of it, and I didn't get a good response the case worker could not answer me don't know why, they should know, I even said what happens if they just sign there kid up to education and he doesn't attend

I do know though, that if the child for example turns 16 in March for argument sake u still gotta pay until September.

Maybe there are making you pay until September and the payments will stop, but u gotta phone them up and find out

Careful tho coz some mothers are money grabbers and will lie and the cms are [censored] biased .

@patrick1986 thank you for the detailed reply! I will take on board what you have said, I really appreciate it!

I can see that my ex would do something like that so I will be very careful!

I will have to give them a ring tomorrow then as the online portal thing seems useless!

They really don't like to help, do they?

I had a different issue where I was made redundant and out of work for three months, I uploaded all of the evidence to suggest this, my P45 and my new work contract which shows I started three months later.

Also with the new job I lost around 45% of my pay. I was assigned a case worker but nothing has come of it. Just a generic message on the online portal saying it would be sorted by May 31st.

I will call them tomorrow! Thank you again!

I'm really sorry if I sounded negative, I'm just going through a lot with them!

I also hope I have not given you the wrong advice,  the portal thing they never normally answer me it's useless feels like they put that into place just to palm you off (not the case tho)

What I been doing is making is demanding to talk to a case worker straight away, and then making them put in writing everything they say, but I don't let then say they do it after the call I make sure they do it while they still on the phone to me lol

They told me that if you loose your job all you need is a P45, and they will put you on nill rate and you don't owe them anything or have to pay, they can only backdate you if you was in arrears before losing your job. They do a re calculation.

You need to speak with a case worker get that sorted! Half you pay is ridiculous! I have that in writing by the way let me know if u need it.

Aww I think I know what they have done with your pay, but double check with them,  say for example your annual review is every May, you get made redundant in July but start work in September, the pr***ks will take your new wage, do there calculation and then divide it with the remaining months, normally it would be spread across 12 months, but this time spread it across the 8 months therefore making monthly payments more. Please don't quote me on that though mate not 100% sure, I could be major wrong but when I spoke about arrears this is how they told me they do there calculation.

Ring them dead on 9:30 otherwise they will keep saying no case worker is available lol and they say they put in a call back but they never call you back.
