Hi,

I divorced nearly two years ago maybe longer and it was written and agreed by the courts that I would stay on the mortgage until the ex was able to remove me. With this it was written in she needed to show effort in removing me, however I am still on it.

Now I am 2 years down the line, and want to move on with my life, but I cant do this as I am still named on the mortgage. I cant get a mortgage for myself as her mortgage is taken in to account even though I do not pay it.

Has anyone, or do you know if I can go back to the courts to be removed from it or put in a deadline to have me off of it by. Would the court see this as acceptable?

Thanks

Hi There,

I don't i'm afraid but is seems that unless she wants to get you removed the not even the mortgage company would help as if you are on the mortgage there is someone else to chase for any missed payments.

The courts may be able to help if it was wriiten in that she had to make every effort to remove you.

Darren
