Can anyone tell me how long it takes once I file for a contact order? Is it weeks or months? When the precedings start, will the judge let me see my child straight away or when the order takes place? Thank you for reading and hope to hear from someone soon.

Hi Im presuming you have sent the c100 to court ?

You will get a court date within a week to ten days after your application , its usually within 4-6 weeks you go to court for the first hearing, which is a direction hearing, which is only about 10/15 minutes , all this hearing is for is to see how to progress and to read the report made by caffcas. They phone you and your childs Mother to see if there are any welfare concerns.
A million dollar question , will you see your child straight away, I would say it depends on the mother and the report, sometimes caffcass can sort something out on the day but its very rare. The second hearing date will be made at the first , ours was made for 12 weeks after to allow time for mediation to take place as this is now the preferred way by the courts. You can arrange this your selfs which will save time

Thank you ak57.

Ive already gone for mediation and she hasnt made contact with them so Ive put the c100 form in today. Shes registered our childs birth without me on it and I found that out by ringing the registery office. I just want to be a Dad to our child, thats all but she has no intention of letting me be that father our child needs. I dont know how women get away with this and there should be tougher laws on mothers to stop them doing this.

Hi, You will need to go for Parental responsibility as well, if you apply at the same time as the c100 its one fee of £200 if you do it separate its £200 each , this will enable you to put your name on the child’s birth certificate . The court may still order mediation, she might go if she’s told to by the court, and you can make it clear that you have offered her this. Did you get the mediator to fill in the form FM1 to say you have tried?

Your right it’s not fair that these women try to shut the Daddy’s out and it’s the right of the child to know who is Father and extended family are

I'm not sure of the answer to this, but if you go into court saying that your ex refused mediation, but even at this stage, you would still like to try that route - what opinion do you think the judge will take of your ex? 🙂

Mediation is now top on the courts lists as a way forward, and its what caffcass recommended its not a cheap way but a worth while way, still a lot cheaper then solicitors. I think its a great idea to get your solicitor to say you have offered mediation and more then willing to go down this route. Why did she refuse mediation ?
