Apart from going through messy divorce and wife applying to court to take daughter away
to Australia - which is a different thread - a new problem has cropped up.

We still live together , hence see my 5 year old daughter every day.
None of us has residency but I have PR .
I take her to school on alternative days and also pick her up occasionally .

Since yesterday wife decided it was too distracting for daughter if I took her to school too, as
only she should be doing so.
Since it was my turn to take her, I tried to get daughter ready and found that her school uniform had been hidden from me.
Ok ..so I let wife get her ready.
When trying to leave with daughter for school, wife created a drama, holding on to daughter tightly and
shouting to leave her alone.
Daughter started crying and I felt that I should walk away for the sake of my daughter.

Calling solicitor to tell her about this was not very successful. Her advice : you can't do anything if wife refuses.

This is very frustrating.... I am worried this will happen again over the weekend, when it is my turn to take daughter out
There must be something legal I can do..?????

...This is more about your wife jockeying for position in respect of the move to Australia I think. The more you are excluded from the daily parenting activities the more weight her arguement carries. She could well be acting on the advice of her solicitor....it wouldnt surprise me!

Theres not a lot you can do I'm afraid, you did the right thing stepping aside because your daughter was getting upset, shame on the mother! It must be very difficult for you at the moment.

What has your solicitor said about the application to remove your daughter to Australia, does she think you have a strong case?

This is the most difficult time of my life!
Wife's solicitor is definitely advising her, I can tell by the rude letters she writes to mine.

This is all about scoring "browny points" for the upcoming court hearing.
The thing is, wife actually hates Australia, after 15years in the UK and I have my suspicion
that she has no intention to re-locate in the near future, as she has made no preparation eg schooling etc

My solicitor is very vague regarding my position in this case as she doesn't really know which way it might go.

Reading several Forums indicates to me that I don't really have a chance....but I have to try!!!

I was hoping that due to my PR my wife could not prevent me from taking part in daughters daily routine.
I am gutted..

Hi Jerry 🙂

If your solicitor is vague about this then she needs to start reading up, try opening a discussion about Payne v Payne and find out exactly how clued up/clueless she is. It might be worth looking for a solicitor that specializes in this area of Family Law. If you're going to part with a few thousand then it should be with someone that can give it the best shot. Just my opinion Jerry... you cant afford to leave anything to chance and a vague solicitor doesnt fill me with confidence for you.

As far as being involved with your daughter, as you live under the same roof you're just going to have to take advantage of every opportunity that arises. She may have hidden the school clothes but you're just going to have to try the same kind of manoeuvering...not ideal I know but its the best you've got right now. 🙂
