[Solved] Not complying with contact order

Hello my ex partner keeps failing to comply with a contact order from court for me to keep my 8 year old for the weekend every 2 weeks. She does it with no valid reason whenever she wants, because she uses the fact that she is on benefits and get legal aid and I have to pay to go to court each time she wants to stop my contact with my daughter, Can I ask to be compensated for money lost from my ex partner?

Hi

Legal aid has now stopped in child contact cases unless there is domestic violence involved, which there obviously isn't, so if it's a new case (ie you are applying for an enforcement order), she isn't going to get legal aid any more, assuming you're not in Scotland.

I wouldn't consider trying to get compensation, the courts rarely award it, and the fact that she is on benefits means that any award would come out of the money that she is using to support your daughter.

My ex kept breaking every Contact Order I was granted over the last 3 years….
3 Magistrates Orders before it got elevated to County Court….3 County Court Contact Orders with Warning notice attached until I finally had to get an Enforcement Order….even now with penalty of imprisonment she’s trying to break contact and give me more [censored] about where me and my child should go and who we shouldn’t see or what we should do etc…

My opinion would have to be don’t let her get away with it anymore and get the enforcement order in place with penalties attached. If you don’t she’ll keep doing this to you until your child doesn’t want to come with you because they have been not used to seeing you

It’s all about Control, Money and hurting you in the only way they can!
