[Solved] residence order

Hi again..

so from my last posts I feel a bit better about the looming contested hearing for prohibited steps order.

However what I am unsure on is, at the time of making the above order I also applied for residence.

What I wanted to know is:
When will the directions start for this
I got a letter from ex legal stating she has completed a c100 form and is applying for a residence order.

Is this normal practice when father applies the mother contests by making her own application.

Hmm, not sure about that - I would have thought she would have just contested your order, but not something I have experience of. I'll ask the CCLC if they can give any advice.

I think counter orders can be submitted but inevitably they will be amalgamated into one case....this happened with my sons residency case. It could be a way of the solicitor increasing his fees!

Thank you for your post.

The Court will contact you with a hearing date when they have processed your application. There is no set time limit for this and will be down to the Court's availability to hear/process your application.

In terms of your ex partner making an application, she is within her rights to do this and the Courts will most likely merge the two applications together so that they will both be dealt with as one hearing.

Your ex partner can apply on a C100 this way to contest the application however when she is served with your paperwork she will have the opportunity to contest this on her Acknowledgement of Service form, the same as you will do once you receive paperwork from her application.
