Hi,
I submitted a C100 with a signed draft consent order which stipulates I have my children 3 nights a week and 50/50 in school holidays. Court hearing is set.
For good reason, I've changed my mind and would like to have the kids 50/50 all year round. Ex does not want 50/50 (for financial reasons, i.e. lack of CMS) so we're now in a position of disagreement.
What is the best way to deal with this? I'm guessing I will need to retract the consent order, understandably I'm likely to need a good reason for this. Then resubmit? Or can I let the court hearing go ahead and make my case there?
Thanks
Hi
Suggest you go to hearing. Write a position statement to let them know what's changed and what are outstanding issues.
