I am seperating and my wife is moving back to the UK from France with my 2 children (6 and 8). We canot agree on finances and it looks like we are going to court to settle.

I must travel back from the UK to maintain access with my children and will need flights, car hire hotels (etc) every other weekend.

Does any one know, will the court make an award for child care and spousal allowance to my-ex wife such that I do not have enough money to have access to my children.

Hi there and welcome 🙂

I honestly don't know but you should ask the judge to bear this in mind. It might help to have a look at the amount you would pay if it was through the CSA and use that as a yardstick. You can google the CSA calculator, input your details and you will be given a guideline amount of what you should expect to pay. 🙂

Yes I tried the CSA calculator and it roughly come up with half what she is asking for- not including any reduction for expenses occuring as a result of access.. The rest she is wanting in spousal maintenance. Even if I pay just the CSA amount then it is financially impossible for me to follow my carear in France and travel home the UK. So effectively I would have to resign from my job - which is in a very specialised field and take a much lower paid job in the UK. In the end neither of us would be any better off but at least i'd get to see my children however it would put at risk my ability to provide for my children in the future.
