[Solved] Fighting for full residency

My ex has made false accusations against me saying that i was physically violent towards her during our relationship but her auntie heard her on the phone admit that i was never physical towards her and her auntie agreed to tell this to social services. My ex also told social services that she ended the relationship but in fact it was me. She has had physical fights with her mum and apparently her mum and nan screamed in her face and even slapped her why my daughter was sat on her knee and this happened in the house her and my daughter live in now. In my eyes she doesn't put the baby before herself and look after her properly. She told me she couldn't mentally cope in another relationship after i ended our 2 year relationship but is already dating somebody else and its only been a few weeks. She suffers postnatal depression and as far as i know is still refusing to take her medication, if she is now taking it she still refused to take it for the first 6-7 months of our daughters life. She has had self confessed mental problems since being a child as she claims seeing ghosts and witches. I want fully custody of my daughter as i don't feel she is safe and i don't think she is getting the care and attention she needs living with my ex.

If i go to social services with the proof to what i have just said will the consider giving me full custody or could they take my daughter into care till it goes to court?. My daughter is quite shy with strangers and i don't want her to go through that, it would kill me.

What proof will i need in court and what are my chances?. I am only 20 and my ex is 19, will my age effect my chances?.

I have been there for my daughter since the moment she was born, i even cut the cord and her first proper word is dad/daddy.

Please help me.

Just a word of caution here......

Just because her family (aunt) has said she'll tell SS what shes like doesn;t mean to say they will........families have a habbit of backing their own!
whatever your ex's family have said or told you about her my not be the same should you end up going through the courts.

i'll tell you this now........what your ex told you about the "mental problems" she had as a child (ghosts/whitches etc...) these will not be repeated in front of anyone of any authority....SS / courts etc...

whatever you claim about her you need to be able to back up with hard proof.......texts/emails/letters etc... not "she said this / she said that" because that is just your word against hers now..........and if she claims the DV card as you've already mentinoned then until you're able to prove her a liar the courts WILL err on the side of caution and you're pretty much against it until you prove you're not. (been there done that - proved her a liar!!)

as long as your daughter is being well looked after and there is no threat to her well being then they would not take her in to care...i think you're thinking a little too far ahead just yet.

try writting a letter to your ex....keep a record (copy) and ask for contact with your child to resume. be nice...no hostility...this is all about your daughter and her right to have you in her life....and that is what is the whole point in being a parent....putting her first now.
