hi every one

im in court on Thursday for a review hearing and ive put together a statement out lining whats happened since we were last at court (feb).
ive been under the impression that the statements have to be sent into the court before the date. however im waiting on a NYAS report and I would really like to include some bits from that. it should be here tomorrow so hopefully I can do I what I have to do with the report and hand deliver the statement to the court on Wednesday.

what im worrying about is will that be enough time for the judge to receive it or will she ignore it because it was delivered too late?

many thanks
martin

Yes it sounds a bit late for the courts and don’t forget your ex/her legal team will need to be issued with a copy if they not in receipt of it already.

Don’t worry….hand it in as quick as you possibly can do and check with the court office that it will be given straight to the judge as its important.
If they won’t accept it (not sure why they wouldn’t) I’d at least have copies available with you for the hearing so you can refer to it and offer it to the judge and the other side on the day if it’s important….if the judge won’t accept it then it may be worth stressing the importance to your case and your child – I won’t say plead with the judge but just explain the reason for the late submission and see what happens.

If you don’t get the report in time and you are sure it contains points you need to help your case then you could always ask for the hearing to be adjourned to be able to include this extra information.

It's the National Youth. Advocacy Service. They perform a similar service to CAFCASS although I think they are more child orientated.

If you explain to the court staff the problems you've had I think they should accept the statement but otherwise Dad-I-d's suggestions are good ones.
